Agreement of Consortium Participation

  • Improvements that will encroach into the public right-of-way require an encroachment permit from the Town of Miami.
  • Paint colors of the body and trim of the building will be chosen by the owner but must be colors that complement the historical nature of the town. Improvements should incorporate elements that are within or enhance the historical architectural integrity of the building. A color palette will be provided for suggestions.
  • The Town of Miami would collectively put the entire project - all the owner’s paint-related/wood framing/door/window needs - out to bid.
  • The bid package will include the “Scope of Work” as defined on page 3.
  • Contract bidders will be invited for an independent walk-through of all the buildings participating in the program within the Consortium. Bidders that have the ability, and can get all the work into one contract, will be considered.
  • Bids will be categorized in accordance with the boxes checked on the “Facade Improvements Requested” section of the “Request for Consortium Participation” form with total costs.
  • Bidders seeking to win the contract will be required to submit their lump sum bids with a detailed breakdown of the cost estimate for each building separately such that each owner would then understand their cost contribution/participation (25%) with the Town of Miami.
  • If the bid is more than $6,000 for an individual owner, the owner will be responsible for the amount over $6,000. This amount will be paid to the contractor upon completion.
  • The owner’s responsibility of 25% is due at the beginning of the project. This 25% will be placed back into the pool of money.
  • Upon receipt of the 25% from all participants, work will commence with a pre-negotiated payment to the contractor driven by the contractor’s manpower and schedule that they have submitted.
  • Each Consortium member’s liability is for their building only.
  • The contractor will determine the completion date and the Consortium, Town of Miami, and Town Council will work with the Contractor to draft a contract.
  • The Town of Miami will recoup the full grant amount from any building owner who sells the building within 36 months after receiving the “BHP/Town of Miami Facade Program” funding. In the event the owner fails to comply with this requirement, the Town of Miami will pursue this action on the legal forum.
  • Consortium Participation forms will be verified by a Town Official for completeness in the order received. This will include any required Town of Miami encroachment, or any other related development permits.
  • All completed Consortium Participation forms will be provided to the bidding contractors during the independent walk-through process.
  • The bidding contractors will provide their bid for the entire project.
  • The Consortium Committee will be comprised of consortium participants, Town of Miami, and construction experts not affiliated with the selected contractor.
  • The contractor will be selected by a Consortium Committee.
  • If the total project is more than the BHP Grant of $92,000, consortium participants will be selected based on the date the Consortium Participation form was verified for completeness up to $92,000.
  • Qualifying participants not making the $92,000 grant, will be placed on a wait list until funds become available from the 25% from owners. This will continue until all funds are exhausted.
  • Formal Notice to Proceed: Following the 25% owner payment and the XX% contractor payment, the Town will issue a formal “Notice to Proceed.” Any work initiated before the Town’s issuance of the “Notice to Proceed” will not be eligible for funds reimbursement.
  • Committee Inspection: The Consortium Committee will inspect the progress of the project as each building is complete to ensure that work was performed as outlined in the approved Consortium Information Sheet.
  • Contractor Submission of Project Expenses, Pictures, and Descriptions: The contractor will be required to submit copies of paid bills, cancelled checks, and receipts. Pictures and descriptions of work completed are required. No final payment will be made until all improvements have been completed to the specifications approved by the Town of Miami and the Contractor.

Scope of Work

  • Detailed measurements of the facade of the building.
  • Photographs of the existing condition.
  • If window frames are requested, approximate length and size of wood framing.
  • If windows are requested, length, width, type, special order, etc.
  • If new door is requested, specification on door is required.
